I QANIK SOFTWARE CONSULTANCY AND INFORMATION TECHNOLOGIES JOINT STOCK COMPANY (“I-QANIK”, the “Company” or “We”) places great importance on the lawful processing of our customers’ personal data. With this Personal Data Protection and Processing Notice (the “Notice”), we aim to ensure compliance with the national legislation in force, primarily the Law No. 6698 on the Protection of Personal Data. Ensuring the security of our customers’ personal data is one of our top priorities. For this reason, we share our customers’ data only with reliable business partners to the minimum extent necessary and take security measures in compliance with applicable legislation to prevent any unauthorized access or data breaches. Transparency is one of our most important principles when it comes to the protection of personal data. This Notice has been prepared to inform you during the processing of your personal data, both while fulfilling our legal obligations and while striving to provide you with a better customer experience. You can find detailed information under the sections “Which personal data do we process” and “For what purposes do we process your personal data”. Another important matter for us is our customers’ control over their own personal data. We take the necessary measures to enable our customers to manage their preferences regarding their data and show the utmost respect for their choices. In this regard, you can submit your requests to us via the communication channels listed under the section titled “Exercising rights by data subjects”. Further explanations on this subject can be found under the section “Rights of data subjects”. You can also find the definitions of terms used in this Notice under the section titled “Definitions”. Data security, transparency, and the right of individuals to control their own personal data are the key foundations for us in terms of compliance with the Law. In this context, we present to you detailed information regarding the processing of your personal data through this Notice.
FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA
This Notice contains our statements and disclosures regarding the processing of personal data belonging to our customers and individuals who contact us, in accordance with the Law and national legislation. We reserve the right to make changes to this Notice in order to provide up-to-date information about our practices and the legal regulations concerning the protection of personal data. In the event of any material changes to the Notice, we will inform data subjects through appropriate channels. This Notice has been prepared to provide information on which personal data is processed by I-QANIK during the course of its commercial activities, for what purposes such data is processed, and to which third parties and for what purposes such data may be transferred. The Notice primarily covers personal data collected through the following channels.
WHICH PERSONAL DATA DO WE PROCESS?
A) PERSONAL DATA PROCESSED WITHIN THE SCOPE OF COMMUNICATION SERVICES
We may process certain data about you through our "Communication Services" channels, which have been established to provide you with better service, enable you to benefit from our products and services, resolve your requests/complaints and suggestions, provide information, and evaluate your applications.
1 - Processing of Your Personal Data via Our Call Centers
When you call our call center numbers related to our I-QANIK brands or when we contact you through these channels, the personal data you provide to us, such as your name and surname, Turkish identity number, mobile phone number, email address, and details of your requests/complaints, may be processed. This personal data may be processed for the following purposes: conducting processes related to company/product/service loyalty, conducting communication activities, managing customer relationship processes, carrying out activities aimed at customer satisfaction, organizing events and managing organizations, conducting social responsibility and civil society activities, following up legal claims, managing contract processes, tracking requests/complaints, conducting product/service marketing processes, and ensuring that data is accurate and up to date. The processing of your personal data for the purposes stated herein may be based on the legal grounds of establishing or performing a contract with you, fulfilling our legal obligations, establishing, exercising or protecting a right, or the legitimate interests of our Company. If at least one of these legal bases is not present, we will request your explicit consent for processing your data.
2 - Processing of Your Personal Data via Our Websites
Through the contact forms available on the websites owned by our Company and our brands, your information such as name, surname, email address, mobile phone number, address, and details of your requests/complaints may be collected and processed. On some of our websites, you may be asked whether you would like to be informed about our campaigns. If you indicate that you would like to be informed, we may process your identity and contact information to inform you about our campaigns, discounts, new products, and opportunities. You may withdraw the permission you have given to receive news from us and about our campaigns at any time. Some of our websites include live chat features. Through these live support channels, your personal data such as mobile phone number and request/complaint details may be collected. In the emails you send to the info/information email addresses of our websites, certain personal data you provide may also be processed. On our websites that use cookies, certain personal data such as your usage habits, preferences, and page visit frequency may be collected through the cookies used. The personal data collected via our websites may be processed for purposes such as conducting communication activities, planning and conducting request, complaint, and inquiry processes, conducting company/product/service loyalty processes, managing customer relationship processes, carrying out customer satisfaction activities and similar purposes, and may be processed based on the legal grounds of contract establishment or performance, legal obligations, the establishment, exercise or protection of a right, or the legitimate interests of our Company.
3 - Processing of Your Personal Data via Our Social Media Accounts
I-QANIK may publish content on social media platforms to reach existing and potential customers through both “organic” and “paid” methods. “Organic methods” refer to content posted on I-QANIK’s own page(s) on the social platform or content that appears in your social media feed because you follow I-QANIK’s accounts (e.g., following I-QANIK's Instagram page). “Paid methods” refer to content shown to users who do not typically follow I-QANIK’s accounts, such as sponsored posts appearing in your Twitter feed. Additionally, when you contact us via our social media accounts such as Twitter, Facebook, Google Plus, or Instagram, you may share personal data such as your name, username, email address, phone and/or mobile phone number, and request/complaint information with us. In such cases, the mentioned personal data may be processed for purposes such as conducting processes related to company/product/service loyalty, conducting communication activities, managing customer relationship processes, carrying out customer satisfaction activities, following up legal claims, managing contract processes, planning and/or executing loyalty-building processes regarding the products and/or services offered by the Company, tracking requests/complaints, and ensuring the accuracy and up-to-dateness of the data. This data may be processed based on legal grounds such as the establishment or performance of a contract, legal obligations, the establishment, exercise or protection of a right, or the legitimate interests of our Company. However, we would like to emphasize that I-QANIK does not have direct access to personal data stored on your social media accounts. Furthermore, I-QANIK is not responsible for the personal data processing, protection, or data security policies of social media platforms. We recommend that you review the privacy policies on the official websites of these platforms to learn more about how they use your personal data.
B. PROCESSING OF PERSONAL DATA OF DEALER REPRESENTATIVES AND/OR EMPLOYEES
If you have applied to become a dealer of I-QANIK, certain information is requested from you in order to evaluate your application. Applications to become a dealer can be made through the websites belonging to I-QANIK or our brands, or by directly submitting documents. The personal data processed of applicants, dealer representatives, and dealer employees may vary from process to process but generally include: full name, address, mobile phone number, title, username, log records, IP information such as transaction security data, instructions and related records, Turkish Identity Number (TCKN), information contained in signature circulars, your instructions and records, and education information. Additionally, although information belonging to legal entities is not considered personal data, in cases where our dealers are sole proprietorships, your personal data such as IBAN, account number, receivable and payable balances, and financial transaction information may also be processed. When you contact our dealer support line, in addition to the personal data mentioned above, your call center record may also be retained.
Your personal data may be processed for the following purposes, based on the legal grounds of contract establishment or performance, legal obligations, the establishment, exercise or defense of a legal right, and I-QANIK’s legitimate interests:

C. PROCESSING OF PERSONAL DATA OF SUBCONTRACTOR REPRESENTATIVES AND/OR EMPLOYEES
If you are a representative or employee of a company that provides services to I-QANIK as a subcontractor, we may need to process your personal data due to the nature of our business relationship and certain obligations. In general, we process your personal data for the following purposes:

D. PROCESSING OF PERSONAL DATA OF SUPPLIER & BUSINESS PARTNER REPRESENTATIVES AND/OR EMPLOYEES
I-QANIK has certain business partners and suppliers with whom we engage in business relations in order to receive services or support on various matters. Within this scope, as you are either an employee or an authorized signatory of these companies, we may need to process certain personal data of yours to fulfill our mutual obligations under the business relationship. For example, your personal data such as your email address or phone number may be processed in order to contact you as part of the services provided. As a representative or employee of our suppliers or business partners, your personal data may be processed for the purposes of conducting and supervising business operations, carrying out communication activities, managing financial and accounting operations, executing production & service operations and sales processes, and ensuring compliance with applicable legislation. The processing is based on the legal grounds of fulfilling legal obligations, establishment or performance of a contract, or the legitimate interests of I-QANIK.
E. PROCESSING OF VISITORS’ PERSONAL DATA
If you visit I-QANIK buildings or facilities, some of your personal data may be processed during or prior to your entry for the purpose of creating and tracking visitor records. These personal data processing activities are presented below for your information:
1 - Processing of Personal Data Through the Retention of Visitor Internet Access Records
When you connect to the I-QANIK internet network as a guest for internet access, I-QANIK is obliged to record your internet access logs electronically and retain them for a period of two years. Under this obligation, your personal data within the internet access records — including internet usage start and end times, IP address, MAC address, visited websites, and log data — may be recorded and retained by I-QANIK. I-QANIK processes such personal data for the following purposes or similar ones:
Conducting activities in compliance with legislation,
Monitoring and conducting legal affairs,
Providing information to authorized persons/institutions and organizations,
Ensuring the security of I-QANIK operations, databases, and internet access,
Establishing and operating information technology infrastructure,
Planning and executing information security processes.
Your personal data may be processed based on the legal grounds of an explicit provision in the law (Law No. 5651), a legal obligation (Regulation on Collective Internet Use Providers – Official Gazette Date and Number: 11.04.2017, 30035), or the establishment, exercise, or protection of a right (providing internet access to you as a visitor), by retaining internet access logs of visitors.
2 - Processing of Your Personal Data through Camera Surveillance
For the purpose of ensuring security, I-QANIK monitors its buildings and facilities through security cameras. In this context, personal data of our visitors may be processed by collecting video footage through camera surveillance systems at the entrances and within the facilities of I-QANIK. The personal data collected through this activity may be processed for purposes such as ensuring the security of I-QANIK campuses, buildings and/or facilities, creating and tracking visitor records, and providing information to authorized institutions as required by legislation. The processing of such data is based on the legal grounds of the establishment, exercise, or protection of a right, legitimate interest, and the necessity of processing for I-QANIK to fulfill its legal obligations.
F. PROCESSING OF YOUR PERSONAL DATA WITHIN THE SCOPE OF JOB APPLICATIONS
When you apply for a job to join I-QANIK and become a part of our team, you share certain personal data with us. In this context, your personal data may be submitted to us via the job application channels on our websites, through third-party companies we cooperate with during the recruitment process, or through other means. The personal data collected during the job application process may include – but is not limited to – your name and surname, address, phone number, email, date and place of birth, educational background, foreign language proficiency, reference information, certificates and professional qualifications, information in your resume, and previous work experience. Additionally, if you voluntarily disclose such information, your criminal record and health data may also be processed from time to time. These data may be used to assess your suitability for the job (e.g., whether your health condition is appropriate for the relevant position or whether your criminal record legally prevents you from working in certain roles). The personal data you disclose may be processed for purposes such as managing recruitment processes, evaluating your job suitability, conducting reference checks, executing human resources processes, and managing candidate applications. The processing is carried out on the legal grounds of establishing, exercising, or protecting a right, forming or executing an employment contract, and I-QANIK's legitimate interests.
YOUR REQUESTS AND FEEDBACK
Your personal data may be processed for the purpose of taking necessary actions regarding any questions, requests, or complaints submitted by you through digital platforms or other written or verbal channels. Your opinions are extremely important to us. Therefore, your personal data may also be processed within the scope of surveys or evaluation studies in order to assess the quality of the services we provide.
TRANSFER OF PERSONAL DATA
Your personal data may be shared with our suppliers, social media agencies, subcontractors, sponsors, and business partners from whom we receive support in the establishment, execution, and termination of our relationship with you, including those who provide products or services on our behalf or with whom we cooperate to offer you such products or services. Your personal data may also be shared with our group companies. Additionally, your personal data may be shared with legally authorized public institutions and private entities within the scope of their authority. In such cases, we take the necessary measures to ensure that the parties with whom personal data is shared process and transfer such data in accordance with the principles stated in this Notice and the provisions of the applicable legislation. Your personal data may be shared with our affiliates, business partners, suppliers, legally authorized public institutions, and legally authorized private organizations within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law. For these purposes and within these limits, your personal data may also be transferred abroad in accordance with the procedures and principles specified in Article 9 of the Law and the decisions of the Personal Data Protection Board. Accordingly, your personal data may be shared with relevant authorities of the country where the operation takes place, to the extent necessary to fulfill operational requirements and comply with international legal obligations.
International transfer of your personal data;
Your personal data may be transferred abroad under the following conditions:
If your explicit consent has been obtained, or
In cases where your explicit consent has not been obtained, but one or more of the other data processing conditions specified in the Law are met:
If there is adequate protection in the country where the data is being transferred, as determined by the decision of the Personal Data Protection Board; or
If there is no adequate protection in the destination country, the transfer may still be carried out provided that our company and the data controller in the foreign country commit to adequate protection in writing and the permission of the Personal Data Protection Board is obtained.
STORAGE OF PERSONAL DATA
When determining the retention periods of personal data, we take into account the applicable legislation and the purposes for which the data is processed within the scope of the relevant process. Within this framework, if there are statute of limitations periods related to the legal obligations regarding the personal data processing activity, these are definitely considered. If the purpose of processing personal data ceases to exist, the data is deleted, destroyed, or anonymized unless there is another legal reason or basis allowing the retention of the personal data. At I-QANIK, the retention periods of your personal data are reviewed periodically. According to these periods, your personal data is destroyed if there is no other legal reason requiring us to process it. If you no longer wish us to contact you, for example, if you do not want to receive commercial communications to be informed about campaigns, we will keep a minimum amount of information about you. Retaining such minimum information is necessary to prevent future contact with you. If you request the deletion of all your information but later wish to use our products or benefit from our services, please note that your previous request to not be contacted may not be recognized. Therefore, along with your request not to be contacted, a minimal amount of your personal data needs to be retained to record this preference in our system.
PRINCIPLES OF PERSONAL DATA PROCESSING
Our fundamental principles regarding the processing of your personal data are: “Acting in accordance with the law and fairness,” “Accuracy and currency,” “Processing data for specific, explicit, and legitimate purposes,” “Ensuring personal data is relevant, limited, and proportionate to the purposes for which they are processed,” “Retaining personal data for the period prescribed by the relevant legislation or for the duration necessary for the relevant purpose.”

At I-QANIK, we use certain technologies such as cookies and pixels (“Cookies”) to improve your experience during visits to our online platforms. The use of these technologies is carried out in accordance with the legislation we are subject to, primarily the Law and the GDPR. USE OF DIGITAL ENVIRONMENTS
Personal data obtained during your use of digital environments may be processed for the purposes of operating and managing the website, conducting activities aimed at improving and enhancing the user experience related to the site and application, monitoring how the site is used, enabling and supporting location-based tools, managing your online accounts if available, and providing information about services that can be used based on your location. If you wish to benefit from the products or services offered within the scope of the application, your personal data will be processed solely and exclusively for the purpose of enabling you to use the relevant product or service.

According to Article 11 of the Law, data subjects have the following rights against the data controller.
Learning whether personal data about oneself is being processed.
Requesting information if personal data about oneself has been processed.
Learning the purpose of processing personal data and whether it is being used in accordance with that purpose.
Knowing third parties to whom personal data is transferred domestically or abroad.
Requesting correction if personal data is processed incompletely or incorrectly.
Requesting deletion or destruction of personal data within the conditions prescribed by relevant legislation.
Requesting notification of third parties to whom personal data has been transferred about the actions taken as a result of correction, deletion, or destruction requests.
Objecting to the occurrence of a result against oneself by analyzing the processed data exclusively through automated systems.
Requesting compensation for damages in case of harm due to unlawful processing of personal data.
EXERCISE OF RIGHTS BY DATA SUBJECTS
Within the limits prescribed by the Law, we respond to data subjects who wish to exercise their rights within a maximum period of thirty days as stipulated by the Law. For third parties to make application requests on your behalf, a special power of attorney arranged through a notary in favor of the person who will apply on your behalf must be provided. Your applications are generally processed free of charge; however, if a fee schedule is introduced by the Personal Data Protection Board, charges may be applied accordingly. To determine whether the applicant is the Data Subject, we may request information from the relevant person and may ask questions related to the application in order to clarify the matters stated in the application.

DATA SECURITY
To ensure the security of your personal data, we take reasonable technical and administrative measures to prevent unauthorized access risks, accidental data loss, intentional deletion, or damage to the data.

Access to personal data within the partnership is managed through a controlled process based on unit/role/application authorizations and according to the nature of the data.

Access to special category personal data is subject to stricter measures.
In cases where access to personal data occurs from outside the company, such as through outsourcing, we obtain commitments from external service providers to ensure compliance with the Law.
We take necessary actions to inform all our employees, especially those with access to personal data, about their duties and responsibilities under the Law.
DEFINITIONS
Explicit consent: Refers to the consent declaration made freely by data subjects based on being informed regarding a specific matter.
Anonymization: Refers to rendering personal data in such a way that it cannot be associated with an identified or identifiable natural person, even by matching with other data.
Relevant person/data subject: Refers to the natural person whose personal data is processed.
Personal data: Refers to any information relating to an identified or identifiable natural person.
Special categories of personal data: Refers to data subject to stricter protection under the Law, which may cause harm or discrimination to the Data Subject if disclosed or lost.
Processing of personal data: Refers to any operation performed on data such as obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, acquiring, making available, classifying, or preventing the use of personal data, whether wholly or partly by automatic means or by non-automatic means as part of a data recording system.
Data recording system: Refers to the system in which personal data is structured and processed according to specific criteria.
Data controller: Refers to the real or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.
THIRD PARTY (REFERENCE) INFORMATION NOTICE
As I QANIK SOFTWARE CONSULTING AND INFORMATION SERVICES INC. (“I-QANIK”), in our capacity as data controller, we will collect, record, store, preserve, keep, transfer domestically/internationally, and process your personal data in a lawful manner within the scope of the purposes stated below, with the most current and accurate data shared with us, limitedly and proportionally to the purpose requiring their processing and related thereto. What is Personal Data?
Pursuant to the Personal Data Protection Law (KVKK), personal data is any information relating to an identified or identifiable natural person. Within this scope, we process your identity data and contact data in accordance with the principles set forth in Article 4 and the conditions regulated in Article 5 of the KVKK for the purposes specified below;
Conducting employee candidate selection and placement processes,
Collecting reference information related to the employee candidate,
Managing employee candidates' application processes,
Conducting communication activities,
Planning human resources processes.
Persons who apply to our Company for a job, their physical/electronic resumes and job application forms containing information such as name, surname, the institution you work for, e-mail, and phone number are processed by I-QANIK based on its legitimate interest, and the information contained in these forms is also used by I-QANIK for its legitimate interests in order to communicate with you verbally or in writing.
We would like to emphasize that if you are listed as a reference person to I-QANIK without your knowledge or if you became aware of this during the fulfillment of I-QANIK’s human resources processes, please notify the person or persons contacting you. Otherwise, our Company does not accept any responsibility.
What is the Method and Legal Basis for the Collection of Your Personal Data?
Your personal data will be collected physically and electronically through printed application forms, e-mails, cargo, verbal interviews, and similar methods including resumes submitted. The collected personal data may be processed automatically and shared based on the legal grounds specified in Article 5 of the KVKK, such as the establishment or execution of a contract, fulfillment of a legal obligation, disclosure by the relevant person, establishment, use, or protection of a right, provided that it does not harm the fundamental rights and freedoms of the relevant person, or the legitimate interests of the data controller. After the completion of the application process, your data will be kept physically or electronically for 1 year to consult your opinion during new job opportunities and possible job offers, or for 10 years following the termination of the legal relationship upon acceptance of the job application.
To Whom and For What Purposes Can Your Personal Data Be Transferred?
The personal data obtained may be transferred, within the framework of the personal data processing conditions and purposes stated in Article 8 of the KVKK and in compliance with the fundamental principles foreseen in Article 4 of the KVKK, to real persons or private legal entities, business partners, shareholders, authorized public institutions and organizations, group and affiliated companies, domestically and/or abroad, with the necessary security measures, for the purposes of planning human resources processes, conducting candidate placement processes, obtaining opinions regarding the candidate, carrying out strategic planning activities, and providing information to authorized persons, institutions, and organizations.
Your Rights Under Article 11 of the Personal Data Protection Law (KVKK)
We would like to inform you that you have the following rights under Article 11 of the KVKK:
a) To learn whether personal data is being processed,
b) To request information if personal data has been processed,
c) To learn the purpose of processing personal data and whether it is used in accordance with its purpose,
ç) To know the third parties to whom personal data is transferred domestically or abroad,
d) To request correction of personal data if it is incomplete or incorrectly processed,
e) To request deletion or destruction of personal data within the scope of the conditions specified in Article 7,
f) To request notification of the actions taken pursuant to paragraphs (d) and (e) to third parties to whom the personal data has been transferred,
g) To object to the emergence of a result against oneself by exclusively analyzing the processed data through automated systems,

Your request will be processed free of charge as soon as possible and at the latest within thirty days. If the requested transaction requires an additional cost, a fee may be charged to you according to the tariff determined by the Personal Data Protection Board.
